About the client: PSS has been mandated to hire a General Manager - Legal (Litigation) for a leading FMCG company. Job Purpose: This is a replacement role that will be leading the resolution of all litigation matters that arise from business operations of our client, a large FMCG company. In time, the role would be groomed and expected to head the overall legal function of the company. Reporting To: Vice President - Legal. It will have a team of 1-2 Managers in arbitration reporting into this position. Key Responsibilities Litigation management: Take care of all litigation pertaining to the erstwhile PFA Act, Food Safety & Standards Act, Legal Metrology Act, COTPA pending before various ADM Courts established under FSSA, District Courts of Different States, High Courts & before Hon'ble Supreme Court of India. Regulatory Affairs: Take care of all the Statutory Compliance envisaged under FSSA, LMA & COTPA related to the Company's Manufacturing units and depots on PAN India basis.Streamline product packaging operations across the company's plants in India. Project management: Due diligence process on new project locations, obtain licenses and approvals, make timely recommendations to goverment agencies and departments for issues related to power, water and effluent discharge. Property issues: Carry out due diligence of new property eg: residential and commercial & industrial and liaise with state industrial development corporations or private parties for completing the land/ property transaction and getting the same registered. Leadership: Manage a team of managers and senior managers in the litigation function. Stakeholder management: Work with functional stakeholders across the legal function including compliance, contracts, disputes and company sectretary. Will also have to engage with external stakeholder including marketing, communications and the CEO as required depending upon the case. Prior Experience & Skills We are looking at a candidate who is strong in litigation and arbitration: consumer compliants, lawsuits, disputes etc. for a B2C/ consumer-oriented company. The candidate can come from consumer or pharma since they would know the arbitration aspects that happen in the industry with an LLB degree or its international equivalent. Would ideally have had 16-18 years of experience working in the consumer or pharmaceuticals industries. Managerial experience in leading parts or all of the legal function would be ideal as this person would be expected to head the legal function in time with a team of 4-5 direct reports at the General Manager level.
